SME Banking Rights 2026: Account Opening, Fees and Complaints

A licence is not a bank approval. A complete application and a documented risk assessment matter. CBUAE’s SME Customer Protection Regulation C 2/2026 took effect on 13 September 2026, replacing the prior SME Market Conduct Regulation.

The three-business-day rule has conditions

Article 4.46 requires systems to complete account opening within three business days where the applicant is assessed as low money-laundering and terrorist-financing risk and standard due diligence is satisfied. The clock starts when the request and all necessary documents and information are provided. Financial-crime compliance can waive that obligation; the rationale must be documented. This is not guaranteed approval for every application.

What to keep in your application record

Save the bank’s document checklist, submission dates, acknowledgements, requests for more information and responses. Confirm beneficial ownership, business activity, expected payment flows and source-of-funds evidence. Ask which documents remain outstanding rather than relying on a consultant’s promise.

Fees and changes to terms

The regulation requires written fee schedules and generally 60 calendar days’ written notice for changes to terms, including fees, subject to its provisions. Article 4.45 prohibits an account-closing fee or penalty after the account has been open for six months or more. Check the product terms and the precise regulatory rule for the charge being queried.

Complaint acknowledgement and final response

Articles 6.5–6.6 require written acknowledgement and a tracking reference within two business days. Article 6.9 requires a reasoned final response within thirty business days, or another period prescribed by CBUAE. These are business days; do not describe the final-response period as thirty calendar days.

Escalation to Sanadak

Complain to the bank first and retain the reference. Use Sanadak’s current eligibility checker before escalating. Its published pages show differing waiting-period wording, so confirm the current requirement directly rather than equating its escalation gate with the bank’s thirty-business-day final-response deadline. Jurisdiction, duplicate complaints and ongoing court cases also matter.

Prepare for banking before you buy a package

Ask the bank for its current documentary requirements. Prepare ownership and beneficial-owner records, licence documents, business activity, expected customers and payments, and source-of-funds evidence.
